Harmless Error 3/10/2008 9:04:41 AM Prosecutorial behavior may be inappropriate but many convictions are upheld and labeled as "harmless error." Today 1 in 100 Americans have been in jail or in prison. The rising numbers of convictions are alarming if you stop to consider how many American's could be innocent.
As Americans we have the right to due process...the right to be proven guilty beyond a reasonable doubt.
What if your right to due process was taken away?
Prosecutorial misconduct is not fiction...and falls into several categories, including:
• Misconduct in the courtroom (inflammatory or inappropriate comments while the jury is present).
• Using false or misleading evidence.
• Improper behavior during grand jury proceedings such as providing false information.
• Mishandling evidence
• Failure to disclose exculpatory evidence.
• Harassment of the defendant or having a vendetta against the defendant.
