Interview with a Top New York Forensic Video Specialist 3/23/2010 8:07:28 AM It’s a sincere privilege for me to have friend and retired New York police officer Mike Lyons stop by to talk about his investigative work in the high-tech world of forensic video analysis. He’s truly one of the “real” CSI forensic specialists that works hard to bring the bad guys to justice.
Jennifer Chase: Welcome Mike Lyons. Thank you for stopping by to chat with me. Please tell us a little bit about your background in law enforcement before we jump into forensic video analysis.
Mike Lyons: There is no such thing as a retired cop telling a “little bit” about their background in law enforcement. Ask a question like that and you better be ready for the long version of his career, which is boring to everyone but him. So settle, here goes!
I worked for the City of Yonkers, NY police department for 25 years prior to my retirement in 2002. The city of Yonkers borders New York City on the Northern border of The Bronx. It is the 4th largest city in the state. I had the opportunity to go into undercover narcotics right out of the police academy. After three years of posing as everything from a street junkie, cab driver, carpenter, city DPW worker (that was a fun assignment buying drugs from city employees in city hall) and even taking on the roll of gun dealer once. I was transferred to patrol when my usefulness as an undercover was up.
Patrol was fun. I did three years there in the worst side of the city. I loved every minute of it, and had a really great partner, but I always had a soft spot in my heart for narco. I guess you could call it a narcotics addiction of sorts. So after a lot of requests for a transfer back to the “leper colony” of narcotics, I finally got sent back. This time I went into enforcement instead of undercover. Enforcement is the search warrant, kick the door down, part of narco. It was around that time that I got promoted to the rank of detective and did a brief stint (about 2 years) in the squad that covered homicides, rapes, robberies, and such. I had my share of each, but finally went back to my first love… narcotics. This time my partner (Joe) and I had the investigation that you only hear about in the movies - 600 kilos of cocaine. It was the operation that we’ve called “the cedar chip trail”.
Following that investigation I was given the opportunity to start up and run the tech unit. That’s where I became a Forensic Video Specialist. I ran that unit for three years before I decided to invest in the same equipment that the department was using, retiring and offering my services to other police departments, attorneys, and private investigators. The day after my retirement Now You See It Investigative Services, Inc. was born.
So there you have it, a 399-word essay answer to “a little bit about my background in law enforcement”. Thanks for listening, now on to question 2. I promise it will be a lot shorter.
Jennifer Chase: It’s always interesting to hear the history of our hardworking law enforcement officers. What’s your current position and/or title as a private investigator?
Mike Lyons: My current position is President of Now You See It Investigative Services, Inc. and I hold a New York State Private Investigator’s License.
Jennifer Chase: Can you tell us a little bit about how forensic video works? Procedures? Timelines?
Mike Lyons: Forensic video analysis is the scientific examination, comparison and/or evaluation of video in legal matters. There are a number of companies out there that do video clarification (enhancement) and processing for legal matters. Basically video processing is the same for forensic work as it is for any other type of video editing. The big difference is in the world of forensics you don’t edit your process to get the video evidence as clear as possible.
In forensic video processing you would never “edit” your work. Editing indicates that the results of the video may be different from the original video and the finished results were altered in some way. Many of the tools, however (software, filters, and hardware), are the same in both fields. You don’t need to be licensed to be a forensic video specialist. What you do need is the proper equipment, and lots of training.
The training is always an ongoing process, as technology is always changing and advancing. Experience is extremely important on the road to being considered an expert in the field. Remember, a concert pianists started out as a piano student and didn’t get to Carnage Hall without “practice, practice, practice!” Same goes for anything. What separates Now You See It Investigative Services, Inc. from all the other forensic video services is the fact that I hold a private investigators license and have investigative experience in various types of crimes. I use those facts to take my forensic video service up a notch by conducting video investigation in conjunction with video clarification for evidence. But forensic video investigations, is a whole other subject. It was suggested that I set up a lesson plan for a course in video investigations designed for investigators (both private and law enforcement).
As far as the part of this question regarding “time line”. I’m not really sure what you mean, but as far as any time constrictions go, depending on the type of video, the process needed, and court dates, every case is different, time wise.
Jennifer Chase: Are you ever called to be a professional witness? For the prosecution? Or, for the defense?
Mike Lyons: Yes, yes, and yes. I have been classified as a forensic video specialist in New York State Supreme Court on cases from homicide to narcotics, for both the prosecution and defense.
Jennifer Chase: What’s the most challenging part of your work?
Mike Lyons: Lately, the most challenging part of my work is collecting my fees. All kidding aside, I think the most challenging part is getting the video evidence ready in time for trial. More times than not, I am brought the video to be processed last minute by attorneys that have had the case for months prior to bringing it to me. But there are a few that understand that processing a 2-minute piece of video evidence can take hours to enhance and process.
Jennifer Chase: What would you like the public to know about your work?
Mike Lyons: It isn’t as simple as on C.S.I.
Jennifer Chase: Can you briefly tell us about one of your most memorable cases?
Mike Lyons: Gee, this is a tough question. I’ve had a few good video cases to choose from. But I think the most challenging, rewarding, and memorable case is the one in Peekskill, New York where a man threw his 10 month old baby girl out of the 7th floor apartment window where she lived with her mother. Miraculously, the little girl survived with only a broken rib, thanks to a large tree that she bounced through in route to the concrete courtyard, like a Plinko chip on the Price Is Right.
In order to make that case ready for trial I had to go to the housing project and retrieve video from a system that had about 16 cameras. After getting the video from several of the cameras and processing them to show in sequence to depict the suspect’s route into the building, into the apartment, and then fleeing the scene after he ran to the court yard to see if the baby was dead. Upon finding the baby still alive, he picked her up and took her to a neighboring city hospital and tried to convince the nurse that she fell down some stairs.
The video and the recordings from the 911 call (I also enhanced the audio) by the mother and grandmother were key pieces of evidence that put the suspect away for many years to come. To put it in perspective, he won’t be going to his daughter’s graduation. Although my video and audio work were instrumental in getting a conviction, I want to say that the Peekskill P.D. and the Westchester County District Attorney’s Office did outstanding work apprehending and prosecuting the case. I would like to add that the Assistant District Attorney on this case is one of the most dedicated A.D.A.’s I have ever had the honor of working with. She stayed with me at my office reviewing a new piece of information I discovered from a video clip until 3:00 A.M. on the morning of the start of the trial (the trial started just 6 hours later, at 9:00 A.M.).
Jennifer Chase: I don’t know how to respond to that incredible story, but to say I’m so glad that the little girl survived the fall and that the perpetrator won’t be getting out of jail anytime soon.
